OpenAI accuses ex-employee of taking unreleased device files; Apple denies it
In a new filing in San Jose federal court, OpenAI alleged that a former employee — who joined OpenAI from Apple, stayed six months, then returned to Apple — transferred more than 100 confidential files about at least one unreleased OpenAI device to personal accounts, some of them on June 2, 2026, his last day at the company. OpenAI said the files included detailed images of the unreleased device, engineering and manufacturing data, supplier information, project files and reports on hardware component coatings and sealing, and that the employee gave a presentation on OpenAI's product plans months ago to senior Apple leaders, including Apple's vice president of operations in Asia. Apple said it has procedures to stop new hires from using a former employer's confidential information and found no evidence supporting OpenAI's allegations, adding in an October 12 letter that the phone numbers OpenAI named did not match the employee's work number and that no OpenAI files were found on its servers.
The escalating AI-hardware trade secrets fight is already producing court-ordered discovery, with a preliminary injunction seen as likely.
